GENERAL TERMS AND CONDITIONS OF DE BIERSALON

Article 1 – Definitions

  • General Terms and Conditions: these General Terms and Conditions of the entrepreneur;

  • Reflection period: the statutory period of 14 days during which the consumer may exercise his right of withdrawal and cancel the agreement without giving any reason;

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur via debiersalon.nl;

  • Day: a calendar day;

  • Continuous contract: a distance contract aimed at the supply of a series of products and/or services, the delivery and/or purchase obligations of which are spread over time;

  • Durable data carrier: any means that enables the consumer or entrepreneur to store information personally addressed to them in a way that allows future consultation or use for a period aligned with the intended purpose and enables unchanged reproduction;

  • Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the reflection period;

  • Model form: the model form for withdrawal provided by the entrepreneur, which must be completed by the consumer when exercising the right of withdrawal;

  • Entrepreneur: the natural person operating under the name De Biersalon, offering products and/or services to the consumer at a distance;

  • Distance contract: a contract concluded in the context of a system organized by the entrepreneur for the sale of products at a distance, using exclusively distance communication techniques up to the conclusion of the contract;

  • Distance communication technique: the means that can be used to conclude a contract without the consumer and entrepreneur being present in the same place simultaneously;

  • Working day: a day from Monday to Friday, excluding officially recognized holidays.

Article 3 – Applicability

These General Terms and Conditions apply to every offer from the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

  • Prior to concluding the distance contract, these terms are made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate how the terms can be inspected and that they will be sent free of charge upon request.

  • For electronically concluded contracts, the text of these terms may be made available electronically, allowing the consumer to store them on a durable data carrier.

  • In addition to these terms, specific product or service conditions may apply; in case of conflicting provisions, the one most favorable to the consumer applies.

  • The consumer can always consult the General Terms and Conditions on the website debiersalon.nl.

Article 4 – Offer

  • If a product has a limited validity period or additional conditions, this will be clearly stated.

  • Offers are non-binding; the entrepreneur may change them.

  • Products include a full and accurate description. Images represent the product as faithfully as possible. Obvious errors are not binding.

  • Colors in images may not exactly match the real product.

  • Each offer clearly states the rights and obligations linked to acceptance.

Article 5 – Conclusion of the Contract

  • Contract concluded when consumer accepts offer and conditions.

  • For electronic acceptance, entrepreneur confirms receipt immediately.

  • Entrepreneur takes technical and organizational measures for secure data transfer.

  • Entrepreneur may verify consumer’s ability to pay and attach conditions or refuse order.

  • Delivery information includes contact, warranties, price, and delivery method.

Article 6 – Right of Withdrawal

  • Consumer may withdraw within 14 days without reason.

  • Period starts day after receipt of product or last shipment.

Article 7 – Consumer Obligations During Reflection Period

  • Handle product and packaging carefully.

  • Product may only be examined as in a physical store.

  • Consumer liable for any devaluation beyond permitted inspection.

Article 8 – Exercising Right of Withdrawal and Costs

  • Consumer notifies entrepreneur within reflection period via model form.

  • Return within 14 days, with all accessories and packaging.

  • Return shipping costs borne by consumer.

  • Additional contracts automatically terminated.

Article 9 – Entrepreneur Obligations on Withdrawal

  • Confirmation sent immediately upon electronic withdrawal.

  • Refund within 14 days using original payment method.

  • Additional shipping costs for more expensive method not reimbursed.

Article 10 – Exclusion of Withdrawal

  • Products excluded from withdrawal must be clearly stated, e.g.:

    • Price linked to financial market fluctuations

    • Products made to consumer specification

    • Personal or hygiene-sensitive products

    • Perishable products

Article 11 – Price

  • Prices fixed during validity period, except for VAT changes.

  • Market-dependent product prices may be variable.

  • All prices include VAT; typographical errors excepted.

Article 12 – Contract Compliance and Warranty

  • Products meet specifications, normal quality, and legal requirements.

  • Manufacturer guarantees do not affect legal rights.

  • Defects must be reported within 4 weeks; return in original condition.

Article 13 – Delivery and Execution

  • Delivered to consumer address or PostNL location.

  • Orders executed within 30 days; delays communicated.

  • Risk of damage/loss remains with entrepreneur until delivery.

Article 14 – Duration Transactions

  • Open-ended contracts: cancel anytime, notice max 1 month.

  • Fixed-term contracts: cancellable at term end, notice max 1 month.

Article 15 – Payments

  • Payment due 7 days after reflection period or 14 days after conclusion.

  • Incorrect payment info must be reported immediately.

  • Reasonable charges may apply for late payment.

Article 16 – Complaints Procedure

  • Complaints submitted in writing within 14 days.

  • Entrepreneur responds within 14 days or sends acknowledgment.

  • Unresolved complaints lead to arbitration after max 3 months.

Article 17 – Applicable Law

  • Only Dutch law applies.

Article 18 – Additional or Deviating Provisions

  • Must not disadvantage consumer; must be storable.

Article 19 – Minimum Age

  • Minimum 18 years for website access or purchase.

  • Non-compliance results in non-delivery; cancellation fee €10.00.
